Property Division

Longwood, Florida, Property Division Lawyer

Florida is an equitable distribution state, which means that all marital property will be distributed fairly between the two spouses but not necessarily at a 50/50 split. Marital property is defined as any asset or debt that was acquired during the marriage with the exception of inherited or gifted property. Any asset or debt acquired by either spouse prior to the marriage is considered separate property and will not be included in the distribution.

Determining what is marital property, assigning a fair value to it and settling on a fair division can be a very complex and contentious process. It is in the best interests of the spouses to reach a property division agreement on their own. If they don't, the court will divide the property for them. The court's decision is binding and the spouses will have to accept the order whether they think it is fair or not.
