Mediation and Collaborative Law Attorney
A divorce proceeding can be a very combative and divisive experience for everyone involved and can often leave emotional scars on the spouses and children that never completely heal. There are alternatives, however, to a traditional divorce that allow the spouses to work through the divorce together and have an equal say in every decision that is made.
Mediation and collaborative law are two opportunities for divorcing couples to work out their differences and reach an agreement without the expense and trauma of a painful court battle. Many couples who have chosen these alternative solutions report being more satisfied with the end result and being more at peace compared to those who have gone the traditional lawyer and trial route.
At the Longwood, Florida based law firm of Michelle A. Barry, P.A., we believe that two adults, with the help of their attorneys, should be able to sit down and work things out. Mediation
Attorney Michelle A. Barry is a Florida Supreme Court Certified Family Mediator. In mediation, attorney Barry would not represent either spouse in the matter. She would serve as an impartial third party and work through every issue that needed to be resolved until an agreement was reached on every one. She would be able to advise each spouse of his or her legal rights, but would not be able to offer any legal advice. Once all issues have been agreed upon, attorney Barry would write the divorce settlement agreement.
Collaborative Law
In a collaborative law arrangement, you and attorney Barry would meet with your spouse and his or her attorney to work through all of the issues together. At the beginning of the process, we would all sign an agreement stating that we were committed to reaching an agreement and that we would not go to trial. At the end of the process we would have a divorce agreement that met with everyone's satisfaction. If not, both attorneys would walk away and the spouses would start over with new attorneys.
